Webinar
Cost Allocation and Indirect Cost Rates

One of the most challenging compliance obligations of federal grantees is ensuring that they charge only “allocable” costs to their federal awards. At its core a very straightforward concept, in practice cost allocation can prove a complex endeavor. From direct allocation, through cost allocation plans, and federally approved indirect cost rate agreements, an understanding of cost allocation principles aids grantees in efficiently and properly recovering project costs from the federal government. Join FTLF Partner Scott S. Sheffler to build from cost allocation basics to intermediate allocation concepts, examine practical examples, and walk through the indirect rate agreement negotiation process.

1 p.m. ET | October 19
Webinar
Federal Procurement Standards

Based upon straight-forward principles of competition and transparency, the federal procurement standards are one of the areas of the federal grant management regulations that contains numerous specific rules and remains an area of compliance focus for auditors and agency reviewers. In this webinar, FTLF Partner Scott S. Sheffler will concisely address procurement considerations, building from the underlying legal principles to the key specific regulatory requirements. He will address competition requirements (including sole source justifications); regulatory options for requests for proposals, sealed bids, or simplified procedures; preferences for small and disadvantaged businesses and domestic sources; and the still relatively new limitations on purchases of certain telecommunications equipment and services from Huawei Technology Company and certain other entities. This webinar is designed to tie the various requirements together into a logical and systemic whole to promote not just compliance, but also efficient and repeatable systems.

Webinar
Internal Investigations Do’s and Don’ts

Although a rare event, every grantee eventually faces a circumstance that warrants a significant internal inquiry – even if the grantee anticipates that it will find that it substantially complied with applicable federal requirements. In this webinar, FTLF attorneys with decades of combined experience in conducting internal investigations will discuss practical considerations, including: (i) depending upon subject matter and posture of the issue upon discovery, who should conduct the investigation and how formal it should be, (ii) when to involve lawyers, (iii) important “do’s and don’ts” in the course of the investigation and follow-on action, and (iv) core systems and processes to have in place to mitigate risk of noncompliance in advance. This presentation will be structured as a panel discussion, with ample opportunity for participant questions.

1 p.m. ET | December 7
Webinar
Subrecipient Non-Compliance

With the advent of the Uniform Guidance, subrecipient monitoring has become a significant area of focus by federal awarding agencies. The Uniform Guidance instructs that grantees are to evaluate the risk of each subaward/subrecipient, then monitor each subrecipient’s performance based upon that risk assessment. However, it does not explain how grantees should structure their subrecipient agreements to create the opportunity to conduct that monitoring or establish the legal rights necessary to take effective action in the event noncompliance is identified. This can lead to grantees acting with too light or too heavy a touch when they perceive a possible area of noncompliance on the part of a subrecipient. In this webinar, FTLF attorney Scott S. Sheffler will discuss matters of subrecipient noncompliance within the broader federal grant compliance framework, connecting potential enforcement mechanisms to important agreement terms and risk for the grantee entity vis-à-vis its federal agency funder.
